  Managing Partner Arthur Shay was invited to be the moderator of "2005 Taiwan Cable and Satellite TV Broadcasting Operations Seminar" held by the Media R&D Center, endorsed by Government Information Office (Taiwan Broadcasting Authority). Arthur Shay
  The development of digital television in Taiwan is soaring in recent years. The Government Information Office (GIO) hopes explore the cable and satellite broadcasting and television industries towards the trend and map out related strategies before the era of digitalization of wireless radio. Therefore, the GIO entrusts the Media R&D Center to hold the "2005 Taiwan Cable and Satellite TV Broadcasting Operations Seminar" on January 11-12, 2005 to form a public forum for related industry operators.

Managing Partner Arthur Shay, with his specialty in the field of broadcasting and telecommunications, was invited to be the moderator of the two sessions: "The Issues of Channel Licensing Royalty and Subscribers Fee in Cable Industry" and "The Role of the Regulators of Central and Local Government in the Cable Industry".

  Managing Partner Arthur Shay invited to address "Whose Rules Does the Broadband Follow – The Regulated or the Unregulated?" on a symposium hosted by the Fair Trade Commission. Arthur Shay
  The Fair Trade Commission (FTC) held the "Digital Convergence and Market Competition Symposium" at Taichung Evergreen Hotel on September 24, 2004 , and invited representatives in industries, governments and academics to discuss the rapid development of digital convergence and related market competition.

Partner Arthur Shay made a presentation entitled "Whose Rule Does the Broadband Follow-the Regulated or the Unregulated?" on the focus of licensing regime to discuss the relations among broadband development, industrial policy, industrial regulation, and market competition. And he analyzed how will the licensing affect market competition, and the methods to stimulate competition by ways of regulated or unregulated. In addition, the discussion extended to what rules should broadband follow in a further analysis on conflicts and cooperation between sector authority and competition agency. In the end, MOD case was discussed for further elaboration on those regulations and licensing planning in the future.

  Managing Partner Arthur Shay attended the "Assessment of Impact on Releasing Additional 3G Spectrum Frequency" seminar hosted by Taiwan Telecommunication Industry Development Association (TTIDA) on June 2, 2004. Arthur Shay
  Ministry of Transportation and Communication (MOTC) planned to release the returned 2x5MHz frequencies of 1900 MHz low tier cordless telephone service in terms of additional spectrum for third generation (3G) mobile communication business. For this reason, the Directorate General of Telecommunications (DGT) of MOTC hosted two consultation conferences this April and May to gather opinions from specialists, scholars and related organizations with regard to legal and regulatory affairs, frequency interference, bottom price for bidding and releasing methods.

On purpose of improving development of telecom industry and the concern of impact on planned case of additional spectrum releasing, TTIDA hosted the "Assessment of Impact on Releasing Additional 3G Spectrum Frequency" seminar on June 2 to invite specialists and scholars to deliver opinions for discussion, and expects to reach consensus on this theme for competent authority reference.

Managing Partner Arthur Shay attended this seminar and delivered a speech on the discussion agenda of releasing additional 3G spectrum.

  Arthur Shay was invited to attend the conference on "The Future of the NCC Organization" held by the Broadcasting Development Fund
  The above captioned conference was held on 11th December. Hosted by Professor
Yo-li Liu at the Department of Radio & Television National Chengchi University, the guests that included Jia-huei Wu, Deputy of the Directorate General of Telecommunications, MOTC, Robert Chi-shen Ho , Section Chief of the Department of Radio & Television Affairs of the GIO, Jack Chang, CEO of PC-Radio Corporation, and our managing partner Arthur Shay, discussed the establishment and future outlook of NCC.

During the conference, Arthur Shay opposed to observing the establishment and development of NCC from a political perspective, he asserted that "the concept of market is vital to the establishment of NCC. The responsible authorities should listen to the voice of the consumers and allow free flow of ideas between business operators and consumers so as to minimize potential conflict. NCC should position itself as a public forum where different opinions could be expressed."

  Hosted by Liberty Times on 16th September 2003, the above-captioned seminar witnessed the discussion on the necessity and suitability of Broadcasting Laws by associated authorities. Managing Partner Arthur Shay was invited on the capacity of a leading expert in the field.

Arthur Shay pointed out that "Taiwan enjoys certain advantages in the development of digital age, as over the past 15 years, the rapid expansion of cable television has served as solid foundation for Taiwan citizens to embrace the era of digital television or digital broadband services. In the next 10 years, we have full confidence in overcoming the digital gap, with the main tool being cable television. Through more lenient legal restrictions and more effective media guiding structure, the cable television may enable Taiwan to showcase our digital achievement to the neighboring countries and even set an example as a leader in the digital industry."

The momentum and the future development of digital television is foreseeable in the powerful combination of the government proposes three-in-one broadcasting television law, communication and broadcasting basic law and communication and broadcasting committee legislations.

  In the seminar titled "Management and Marketing of Telecommunication" hosted by the National Chengchi University on the 2nd September 2003, Arthur Shay was invited to speak on "the telecommunication market in China and Hong Kong".

The seminar was held as a result of increased competition in the telecommunication industry after the liberalization of telecommunication and internet services. How should the telecommunication business face the challenge and impacts of globalization? How should new comers fight for market shares? How should people both within and outside the industry keep themselves abreast with the latest development? The huge market potential in Hong Kong and Mainland China the various applicable framework and policies are particularly important issues on the agenda.

  Mr. Arthur Shay, the managing partner, was invited by the Broadcasting Development Fund to participate as a speaker to talk about digital copyright control in the Development and Policy Planning of Digital Media Discussion Forum sponsored by the Broadcasting Development Fund on July 10, 2003 at the Administration Building of Taipei County.

In order to follow the global trend of digitalization, Taiwan's media industry is moving gradually into a digitalized era. However, there are several obstacles that lie in the path of media digitalization. The Broadcasting Development Fund, in organizing the discussion forum on the development and policy planning of digital media, wishes to discuss the potential of digital media industry and to explore the possible solutions to overcome these obstacles. Attorney Arthur Shay was invited by the seminar series "Strategic Planning of Commerce Digitalization" hosted Department of Commerce, MOEA to lecture "E-commerce Law and Case Study" on April 16, 2005 (Saturday) in the campus of National Chung Cheng University.

To fulfill better operational performance of enterprise under the trend of e-commerce, the Department of Commerce creates a series of seminars "Strategic Planning of Commerce Digitalization" through traditional lecture, group study, strategic seminars and latest e-learning manner to achieve the goal of lifetime learning and upgrade the value of overall enterprise in line with the international trend. The series course were beginning from April of 2005, every Saturday in National Chung Cheng University.

Among various planning of commerce digitalization, law is a critical factor. How to use the electronic information to protect your interests and not to infringe others’ interests will be an important issue that shall not be ignored.

  Attorney David Wei addressed the Bureau of Employment and Vocational Training, Council of Labor Affair on "The False and Deceptive Ads Issues Under the Consumer Protection Law and Fair Trade Law"
  Attorney David Wei was invited by the Bureau of Employment and Vocational Training (BEVT) to make a speech to the colleagues regarding consumer disputes and protective measures.   The problems associated with SPAM include: significant increase of production cost for businesses and internet users, provocative and controversial contents, waste of internet resources, hacking of electronic transactions and internet security as well as negative impact on the confidence level of internet users just to name a few. Various countries have established necessary legal constraints to combat potential damages of SPAM. The conference "2nd OECD WORKSHOP ON SPAM" was hosted by the Organization for Economic Co-operation and Development from 8th to 9th September, 2004 allowed representatives from different countries to discuss practical and feasible solutions.

Managing Partner Arthur Shay attended the conference as the e-commerce expert of NICI on behalf of the Taiwan government and was the speaker at Session 1 Panel Discussion.   Managing Partner Arthur Shay gave an E-commerce lecture titled "Transactional Safety Scheme and Current Development of Electronic Finance" for the 2nd Senior Class of Electronic Finance Extension Education of the Taiwan Academic of Banking and Finance (TABF) on May 18, 2004.
  To confront with the challenge in the era of knowledge-based economy, the TABF actively promotes the financial learning environment of knowledge-based economy and enhance the quality of financial professionals. By means of educational training, it will encourage staff’s ability on core knowledge and comply with business operational strategy and overall development.

The Senior Class of Electronic Finance has won high praise ever since it commenced last year.   To assist online stores towards the sound development, the Department of Commerce of MOEA particularly plans the training courses for the seed talents of B2C e-commerce. On the main theme of "How to Be a Reliable Online Store", the course will elaborate the self regulation on the cyberspace, establishment of online reliable payment service, creation of reputation of good brands, and provide related legal issues in operating an online store to help the online store owners to establish the B2C stores the consumers can rely on and promote the sound development of e-commerce consuming environment.

  Educational training "A Research on the New Government Procurement Act and Case Study" by Attorney David Wei
  The amendment to the Government Procurement Act (GPA) promulgated in February 2002. Attorney David Wei picked several important articles providing for audience to easily understand the new procurement measures in the amendment, for example: some kinds of invitation to tender need no approval by the superior entity, relax the requirements of limited tendering, revising the time-limit for tendering, regulations on the bid bond and guarantee bond, the alternatives of supplier's qualification to tender, and the relief and settlement of a dispute in relation to the performance of the contract in question.   In the attempt to gain a better insight into the highly controversial issue of Spam, the Legislative Yuan invited our Managing Partner Arthur Shay to speak on the status of Spam in the international arena and the applicable policies and appropriate strategies in Taiwan.

  On On 28th November, 2003, at a forum entitled "Cyberspace: Info-communications, Law, and Society" hosted by the Institute of Law for Science and Technology at National Tsing Hua University, Attorney Arthur Shay delivered a speech on "New regulations on internet transactions in the new century – human dignity and commercial benefits."

In this two-day forum, experts in the fields of information technology, law and internet safety as well as relevant government legislative department officers were invited to discuss the potential impacts of the application of some primary technology such as IPV6, with the hope of gaining greater insight into the development process of international cyberspace and its future outlook.

  E-HUB E-commerce interaction platform is a point of contact for multiple-users to perform various activities on the internet. The multi-purpose E-HUB E-commerce interaction platform could be utilized to provide information on product services and to serve as transaction channel between buyers and sellers. The operation of E-HUB E-commerce interaction platform raises legal issues of fair competition that is identical to the traditional antitrust problems, to combat which the Scholars in the field suggest fair competition legislations as sufficient legal source. The majority of scholars in the country and abroad believe that provision of adequate strategic guidance to E-HUB E-commerce interaction platform operators could avoid potential unfair competition. The development of e-commerce has no doubt out-paced the implementation of relevant legislations. While taking advantage of the convenience brought about by e-commerce, any related legal issues should also be considered as precaution.

  Completion of "E-commerce Escrow" Report
  "Escrow" refers to the situation when a third party is legally appointed or assigned to hold custody of certain documents, contracts, money, securities or other properties and assets; in the event of the occurrence of specified event or condition, the appointee then transfers the concerned properties to designated person. The Escrow transaction method sufficiently protects the rights of both buyers and sellers hence promotes consumer trust on e-transactions and encourages more online shopping and other activities on the internet. On the other hand, the unrestricted expansion of Escrow business has led to the establishment of virtual Escrow companies conducting fraudulent internet activities. Closer surveillance of Escrow operators and the enforcement of stricter selection of members and suitable compensation structures may efficiently decreases the likelihood of fraud while promoting transaction safety.   Arthur Shay, the managing partner, has been invited by the Department of Commerce, Ministry of Economic Affairs, to hold a session for its commercial datamation strategy and planning seminars. He will be giving a lecture at the National Chung Cheng University on Saturday, July 12, 2003 on "E-Commerce Law and Case Studies".

In order to achieve e-commercialization of businesses in their administration and operation, the Department of Commerce, Ministry of Economic Affairs, has set up commercial datamation strategy and planning seminars. It wishes to accomplish the goal of lifetime learning through traditional lectures, group reports, strategy seminars and e-learning web-based education to promote the overall output value of local businesses in line with global trends. The seminars will be held every Saturday at the National Chung Cheng University from June 21, 2003, to August 2, 2003.

  Arthur Shay delivered the speech at "Copyright Law Seminar", hosted by Commonwealth Publishing Company Editorial Department Research and Study Workshop
